These Terms explain the rules for using Perto, a family WhatsApp monitoring service offered at pertozap.com.br by Simplifica Gestao Software LTDA, CNPJ (Brazilian company registration number) 39.560.235/0001-73, headquartered at Rua Julio Abreu, 160, sala 1205, Varjota, Fortaleza, CE, CEP 60160-240 ("Perto" or "we"). To use Perto, the account holder accepts these Terms, and the acceptance is recorded with the version of the document (section 16). How we process personal data is explained in the Privacy policy. We wrote these Terms in plain language on purpose. If anything is unclear, contact us at contato@pertozap.com.br.

1. What Perto is

Perto automatically analyzes the WhatsApp messages of the people the account holder connects, in one-on-one chats and in the monitored group chats, and notifies authorized recipients when it finds signs of possible risk, such as scams, harassment, inappropriate content, bullying, threats and unwanted contact. It also sends summaries and, depending on the plan, the profile and the rules in these Terms, makes it possible to view the alert excerpts (the messages behind each alert) and the chats.

Perto works as a linked device on the person’s WhatsApp, the same way WhatsApp Web does. No app is installed on their phone.

2. Definitions

  • Account holder: the adult who signs up for and pays for the subscription and manages the account.
  • Legal guardian: a person with legal authority over the child or adolescent (father, mother, guardian or custodian).
  • Monitored person: the owner of the WhatsApp number connected to Perto.
  • Authorized recipient: a person invited by the account holder to receive alerts about specific monitored people, with the permissions set in the invitation.
  • Interlocutor: anyone who chats with the monitored person or takes part in group chats with them.
  • Data subject: any person the data relates to, including interlocutors.
  • Alert: an automatic notice about a possible risk, with a priority and a confidence level.
  • Restricted content: an image, video or sticker classified as graphic (violence, accident, death) or sexual, which arrives covered (section 9).
  • Connection notice: a short message that Perto may send to the monitored person, if the account holder chooses, saying that the number has been connected and who connected it.

3. Who can sign up

People aged 18 or over with full legal capacity. The account holder declares that they are of legal age when signing up and is responsible for the truthfulness of the statements they make. The account is personal and non-transferable. We may ask for information to be confirmed when there are signs of error or fraud.

4. Who can be monitored

4.1 Children and adolescents

Only a legal guardian may connect the WhatsApp of a child or adolescent. When connecting each person, the account holder declares the relationship (father, mother, guardian or custodian). Notifying the child or adolescent through Perto is the legal guardian’s choice.

4.2 Adults

The WhatsApp of an adult, including a father, mother, grandmother, grandfather, spouse or partner, may only be connected with that adult’s authorization. When connecting, the account holder declares that they have this authorization. The connection notice is optional and does not replace the authorization. Perto may ask the adult to confirm the authorization personally, through their own WhatsApp, at any time and whenever there is a dispute.

An adult’s chats only appear on the Complete plan after the adult confirms, through the link in the connection notice, that they authorize this viewing. The adult may withdraw the authorization and end the connection at any time.

4.3 People under curatorship

The curator (curador) may connect the WhatsApp of the person under curatorship (curatela) when the court decision gives the curator powers to do so, and presents the decision whenever Perto asks. The person under curatorship is informed of the monitoring whenever possible.

4.4 Turning 18

When a monitored person turns 18, the relationship declaration is no longer valid and the rules for adults apply (section 4.2). If they do not give their authorization within 7 days after turning 18, the connection is ended and the account holder is notified.

4.5 How the connection is made

The connection is made by scanning the QR code generated in Perto with the person’s WhatsApp. It appears in the person’s WhatsApp under Linked devices and can be ended there at any time. When connecting, the account holder chooses whether Perto sends the connection notice. Perto only generates the QR code after recording the declarations required for that person.

4.6 Verification, shared custody and disputes

  • A declaration is not always enough as proof. When there is a dispute, a report, an inconsistency or another sign of risk, we may ask for documents proving the relationship or the authorization (for example, a birth certificate or a custody or guardianship document), to the extent the case requires.
  • Under shared custody, either legal guardian may connect the child’s WhatsApp. If the other legal guardian disputes it, we may suspend the connection until the two reach an agreement or until a court decision, and we inform the account holder.
  • If the account holder loses legal authority over the child or adolescent (for example, by a court decision), they must end the connection. Once proof of this is received, Perto ends it.
  • Anyone who believes they are being monitored without authorization, or the other legal guardian, may dispute the monitoring by emailing denuncia@pertozap.com.br. During the review, we may suspend the connection as a precaution. The account holder is informed and may submit documents.

5. Access, invitations and permissions

  • Paying for the subscription does not give unrestricted access to the chats. What each person can see depends on each number’s plan, the profile, the monitored person’s age, the authorizations on record and the permissions given in the invitation.
  • The account holder may invite authorized recipients. Each invitation sets, for each monitored person, what the recipient can do: receive alerts, see alert excerpts, see the chats (on the Complete plan, when allowed) and change settings.
  • Permissions can be changed or revoked at any time, and a revocation takes effect immediately. The account holder is responsible for the invitations they send and the permissions they give.
  • Access to the account uses a code that Perto sends to the WhatsApp of the person signing in (or to their email, if WhatsApp is not available). Do not share this code: Perto never asks you to send it in a message.
  • Alerts are sent from Perto’s own WhatsApp numbers, listed at pertozap.com.br/numeros. Be wary of messages in Perto’s name that come from other numbers.
  • Every access to chat content is logged. The account holder can see these logs. A monitored person who received the connection notice can see, depending on their age, the record of access to their own chats.

6. Prohibited use and measures

Perto may not be used to:

  • connect an adult’s WhatsApp without their authorization, or monitor someone covertly when the law requires that the person know;
  • connect the WhatsApp of a child or adolescent without being their legal guardian;
  • stalk, control, coerce or intimidate anyone, including a spouse, partner, ex-partner or employee;
  • share chats, excerpts, screenshots, exports or other data obtained through Perto with anyone who does not have permission to see them;
  • obtain, keep or disclose anyone’s intimate content;
  • hide the connection or the connection notice from a monitored adult;
  • pursue any unlawful purpose.

Depending on the severity, we may investigate, restrict access to content, suspend connections, suspend or terminate the account, preserve records and, when the law requires, report to the authorities. If there is a plausible risk to someone, the suspension may be immediate. The account holder is informed of the measure and the reason, unless the law or someone’s safety prevents it, and may dispute it by emailing denuncia@pertozap.com.br. Reports of misuse go to the same address.

7. How the service works and its limits

  • Perto analyzes messages from the moment of connection. Earlier messages are not read.
  • The service covers WhatsApp only. Calls, other apps, SMS and content that WhatsApp does not deliver to linked devices are not covered.
  • The connection can drop, just like WhatsApp Web’s. When it drops, we notify the account holder, and the QR code has to be scanned again with the monitored person’s phone; until then, monitoring is on hold. WhatsApp may also change its rules or restrict accounts, decisions we do not control. Perto is not affiliated with WhatsApp or Meta.
  • Delays and interruptions can occur, for example due to failures in the connection, in providers or in Perto itself.
  • Perto is not an emergency service and does not replace the police, the Conselho Tutelar (Brazil’s local child protection council), health professionals or dialogue within the family. In Brazil, in case of danger, call the police at 190.
  • Perto does not block contacts, delete messages, leave group chats or send messages from the monitored person’s WhatsApp.

8. Alerts and artificial intelligence

  • Alerts and summaries are generated by automatic rules and by artificial intelligence systems. False positives (an alert about something that was not a risk) and undetected risks can occur.
  • An alert is not a diagnosis, conclusive proof of a crime or a guarantee of protection. It indicates a possible risk, with a priority and a confidence level, for the family to assess. Decisions about what to do are always the family’s.
  • To dispute an alert, mark it as a false alarm in the app, with an optional reason, and request a review. The review is done through a new automatic analysis, which explains why the alert was kept or withdrawn, and is answered within 5 business days. A review by a member of the team only happens if you request it and expressly authorize it, is limited to the excerpt of that alert and is logged.
  • The monitored person and interlocutors may also request a review of decisions made solely on the basis of automated processing, as provided by the LGPD (Brazil’s General Data Protection Law, Law 13,709/2018), by emailing privacidade@pertozap.com.br.

9. Chat content and restricted content

  • Chats belong to whoever wrote them. Perto processes this content only to provide the service, as described in the Privacy policy.
  • Messages received on the monitored WhatsApp remain stored for the plan’s retention period, even if the sender later deletes them, and can be viewed depending on the plan and the profile.
  • Graphic content (violence, accident, death) arrives covered. On the Complete plan, anyone with access to that number’s chats can open it with a tap, and opening it is logged. On Essential, only the description appears.
  • Sexual content is never shown, on any plan. The family receives the alert, a neutral description and guidance. When there is no indication that it involves a child or adolescent, the file is deleted after the analysis.
  • Sexual content that may involve a child or adolescent is never made available to the family or the team. The file is kept isolated in a restricted environment, solely for reporting to the competent authorities, as provided by the Estatuto da Criança e do Adolescente (Brazil’s Child and Adolescent Statute), and is deleted after the authority confirms receipt.
  • We do not use chat content for advertising, and we do not sell it.

10. Free trial

To start, you enter a credit card on Stripe’s payment page. The trial lasts 7 days, counted from sign-up, and nothing is charged during that period. If you do not cancel by the end of the 7th day, the first monthly fee is charged to the card the next day and the subscription then renews every month. Each account holder and each card is entitled to one trial.

11. Plans, price and payment

  • There are two plans, Essential and Complete. The 1st monitored WhatsApp number is always on Complete; each extra number goes on Essential or Complete, as you choose.
  • The monthly fee is the sum of the 1st number and each extra number, at the price of each one’s plan, according to the prices published on the site at the time of sign-up. Example: the 1st number (R$49.90) and one extra number on Essential (R$27.90) come to R$77.80 per month.
  • The subscription is monthly and renews automatically on the card on file until you cancel. There is no annual plan.
  • Each number comes with a limit on how many people receive its alerts: up to 2 for numbers on Essential and up to 5 for numbers on Complete.
  • The minimum is one number, the 1st. You can add or remove numbers and change the plan of extra numbers at any time in your account. If the 1st number is removed and there are others, you choose which one becomes the 1st, on Complete, and see the new total before confirming. Added numbers and moving a number to Complete are charged pro rata right away. Removed numbers and moving a number to Essential take effect from the next billing cycle; from then on, that number’s stored chats follow the Essential retention period.
  • During the trial, these changes do not generate charges. The first monthly fee is based on the numbers and plans in place on the 8th day.
  • Payments are processed by Stripe. Perto does not store your full card details.
  • Notice of price changes is given at least 30 days in advance.
  • The tax invoice (nota fiscal) is issued to the CPF (Brazilian individual taxpayer number) you provide in your account.

12. Canceling, stopping and deleting

These are three different actions, and each one can be done without the others:

  • Canceling the subscription ends billing at the end of the period already paid. Until then, monitoring continues. The 7-day period for withdrawing from a contract made online (art. 49 of the Código de Defesa do Consumidor, Brazil’s Consumer Protection Code) coincides with the free trial: anyone who withdraws within this period pays nothing. After the first charge, cancellation takes effect at the end of the paid period, with no refund for the period already started.
  • Stopping the monitoring of a number disconnects the number and stops collection immediately. Billing for that number follows the rules for changes in section 11, and data already collected follows the retention periods in the Privacy policy, unless deletion is requested.
  • Deleting data erases the data of a number or of the account, at Perto and at its providers, within 15 days. The only data kept is data the law requires us to keep or data preserved by order of an authority.

When the subscription ends, at the end of the period already paid for, data is kept for another 30 days in case you come back, and is then deleted.

13. Failed payment

If the charge is not approved, we let you know and try again. Monitoring continues for 7 days. After that, it is paused and all authorized recipients are notified. Data is kept for 30 days from the start of the pause and then deleted.

14. Responsibilities

The account holder is responsible for:

  • making truthful declarations about legal age, legal relationship and the authorization of adults;
  • giving permissions carefully and revoking them when appropriate;
  • keeping access to the account, and to the devices where it stays signed in, secure;
  • using information from Perto lawfully and responsibly, without exposing the people involved.

Perto is responsible for providing the service with care, fixing failures promptly, processing data as described in the Privacy policy and being liable for its own failures, as provided by law.

These Terms do not limit consumer rights or Perto’s liability for failures of its own service. Due to the nature of the service (reliance on WhatsApp, automated analysis and information that only the family knows), Perto does not guarantee that every risk will be identified.

15. Suspension and termination

We may suspend or terminate accounts and connections in the situations described in section 6, in case of fraud or under a lawful order, giving the reason whenever possible. You can terminate your account at any time; data is deleted as described in the Privacy policy.

16. Acceptance and versions of these Terms

  • Acceptance of these Terms is recorded with the version of the document, the date and time from our server and the access method used. You can read and download, in your account, the versions you have accepted.
  • Notice of significant changes is given in advance, by email and WhatsApp. When a change requires new acceptance, you are asked for it the next time you sign in. In these cases, simply continuing to use the service does not count as acceptance.
  • If you do not accept a new version, you can still cancel the subscription, contact support and exercise your rights over your data.

17. Governing law and venue

These Terms are governed by the laws of Brazil. The courts of your domicile are chosen as the venue, as provided by the Código de Defesa do Consumidor.
